与老外签订工作合同的话,这个合同是要以老外所在国家的劳动法,福利待遇,法定节假日以及相关规定为准吗?主要还是在国内工作的,国内和国外节假日也不一样,劳动法律规定也不一样...
老外订立的合同太过冗长,复杂,很多陷阱,大家帮忙看看下面几个条款,是否合理,有没有什么问题?
You will be employed on probation for a period of 6 months.
PLACE OF WORK
You will be employed principally in China.
However, within reason and subject to reasonable notice, you may be required to move location and to work at other locations.
Your normal working week will be 5 days, forty hours per week.
Your normal working hours will be flexible. The Company reserves the right to change these working hours. You will receive as much notice as is reasonably possible prior to any change.
There will be an unpaid meal break of 1 hour per day.
You may be required to work overtime depending on the requirements of your work and at the discretion of management. Where possible you will be notified in advance. Such additional time will be unpaid.
Your Gross salary is RMB Per Month and this is paid on 15th of each Month this is subject to statutory and other agreed deductions.
You will be paid monthly in arrears on or about the middle of each month.
You are paid by Credit Transfer.
Annual leave entitlement is 21 working days per year, not including normal public holidays, and shall be given in accordance with the provisions Part 3 of the Organisation of Working Time Act, 1997.
No more than two consecutive weeks may be taken at any one time.
The holiday year is from 1st January to the following 31st December.If you have joined the Company part way through a year the holiday entitlement shall be calculated on a pro rata basis with reference to the number of completed months worked.
You will not be entitled to payment in lieu of any unused part of your holiday entitlement except on termination of the employment.
Annual holiday dates should be submitted at least one month in advance for approval.You must obtain the consent of the Company to your proposed holiday dates.Consent will not be unreasonably withheld, but always having regard to the needs of the Company's business.
Certified Sick leave will not impede on Holidays.

Holiday entitlement is not cumulative and shall not be carried over into the following year.

骗局倒不是,主要是合同内容太复杂,有些规定太过苛刻了
