我们有一个信用证是去年8月8号过期的，信用证条款是发货并提交相关单据后付90%，买方收到货并验收合格后付10%。去年6月份我们发货，7月份开证行一次性付了全款到我们的汇丰账户，当时我还以为客户图省事让银行一次性付了。但是昨天接到汇丰的通知，说开证行要求退回10%，理由是他们当初“错误的”付了100%给我们。此时离信用证过期已经过去半年，开证行现在提出这个要求是合理的吗？(此前我们没有接到客户任何有关产品质量的通知。)

lewis9898：置之不理。你們可以告知客戶，由於中國政府實行外匯管制，已經兌換成人民幣的款不允許再返還給匯款方了。

ketch：不是客户要退回，是开证行要求的。跟客户沟通，客户也说不用退回了，并且已提交验收合格的资料给开证行。我这边也告知汇丰不要退回这10%。不知道开证行接下来会怎么处理。

大家伙都没明白其中的道理。
丁是丁，卯是卯，一个萝卜一个坑。不能硬说开证行的做法没有道理。他们应该有他们如何走帐的财务需要。
这种事，我在银行做事时也接触过。大抵处理是：退给开证行10%。客户再与银行办理相关手续，重新打给你们10%。
另外，信用证的过期与否，与本案涉及的退款事没关系。这点要清楚。

awen2188：It must be known that in the financial practice ofissuing bank, the 10% of the amount they overcredited to the beneficiary must be debited. So that their corresponding account can be balanced. That's why the issuing bank insisted on taking back the 10% they had paid by mistake.

这是昨天客户工作人员回复我们的邮件 (ABC指我们公司，GRN即是付10%所需的文件)：
This is not the issue between ABC and the Client, this is between the Client and the issuing bank (UBL Karachi).
The issuing bank released 100% LC payment against shipping documents instead of 90% payment. The client asked UBL that on which authority you paid 100% payment instead of 90% payment before issuance of GRN.
This is the reason that the issuing bank is asking HSBC to refund the 10% LC payment so that they can settle this issue from your 10% payment.
We advise youNOT TO RETURN 10% LC PAYMENT to the issuing bank. If you refund 10% payment than ABC will not get 10% payment back until the case is resolved between the client and issuing bank and it may take longtime and both banks HSBC and UBL Karachi will deduct the bank charges from your account.
So please inform your bank to reply the issuing bank that GRN was issued on 24-08-2017 and a copy had already been provided to issuing bank by the client also. Issuing bank should settle this issue with the client. ABC/HSBC takes no responsibility at this stage.
