请教以下一道CDCS试题：
one hundred percent of the proceeds of a confirmed documentary credit have been assigned by the beneficiary to a third-party financer. The credit terms require shipment of goods in two lots ,the first in March and the second in April . On 15 April ,the confirming bank receives one presentation of documents for the crdit value containing separate documentation relating to each individual shipment. The documents evidence shipment of the first lot of goods on 2 April and the second set on 8 April. What actions should the confirming bankd take ?
1. honour the documents ;
2. notify the assignee that no proceeds are payable and documents are held at their disposal.
3. refuse the documents that relate to the first shipment but otherwise pay the proceeds of the second shipment to the assignee
4. withhold payment on both shipments and refuse the documents .
A. 1 only;B. 2 and 4 only

我个人觉得这题的考点是分期出运还是分批出运，根据ISBP745 Para C15 a 的规定，应该是分期出运。根据UC600第32条规定，第一期没有按照规定出运，那么信用证对该期及第二期均已失效，所以答案选B。

xianyungz：我觉得应该是D，这是属于分期装运了，三月没有按期出货，以后各期就失效了，所以保兑行应该拒付，并且把文件转给开证行。

你提醒我了，你选的答案应该是正确的；但你说“保兑行把单据转交给开证行”的说法估计是错误的。
因为根据UCP600第16条 “不符单据及不符点的放弃与通知”的规定，保兑行拒付后，如果没有交单人进一步指示，是不能将单据转交给开证行的。
xianyungz：我只记得在相符交单下，如果保兑行承兑了，就必须把文件转交给开证行；
在不符点下，应该是按你说的那样处置文件。毕竟，在未付款前，单据的所有权属于交单人。

剑鱼：这个问题其实很明显——信用证规定分两期装运，而受益人从第一期开始就没有按时装运，因此，该信用证就此作废。而单据交给的是保兑行，那么保兑行肯定是拒付——从这点出发就是选择答案的要点。

我好像应该明白剑鱼兄的意思了。这信用证是作废掉了，不是简单的不符点；所以开证行无需做这个动作“notify the assignee that no proceeds are payable and documents are held at their disposal.”
对吗？

是的——因为是信用证作废了，而不是单据付问题。所以保兑行直接拒付。

谢谢剑鱼兄。那如果不是交单给保兑行，是交给被指定银行的话，应该也不用发 拒付通知吧？
